This is the era of online shopping most of the population would like to purchase online-

because it gives ease of buying and options without visiting places, cheaper products, competitors products, variety etc. This article gives you insight into everything required to start an online seller's business followings are the steps to start :

Step 1. - Legal requirements and compliances:-

1) Formation of business entity:- first of all you need to choose the type of business you want to start you can start with a sole-proprietorship firm, partnership firm, LLP, Pvt. Ltd Company or a limited company. If you are new in the business and just want to start as a pilot project ( for testing ) we suggest you should go with a proprietorship firm. it is easy to start and close with limited compliances. for forming a proprietorship firm you just need to have the following :

  • PAN card

  • Valid ID proof

  • Valid address proof

  • electricity bill ( latest, not older than 2 months)

  • if property/business on rent then copy of rent agreement

  • NOC from the owner

  • if the property is not on rent then NOC and electricity bill from the owner of the property

  • Bank account

2)GST registration: It is mandatory to have registration with the GST department to sell goods or services through online platforms like Amazone, Flipkart, Misho0 and others. Registration is mandatory and the limit for registration is ZERO. Yes! you need to be registered and raise GST invoices from day one.

Basic of GST compliances - you need to file monthly/ Qtrly returns for sales and net taxes. You need to deposit tax collected from customers to GOVT. account.

WHAT IT COSTS TO YOU AN ESTIMATION :

It costs you around Rs. 15000/- yearly ( RS. 1250 MONTHLY) for having GST registration and compliances for small businesses.

3) TRADEMARK REGISTRATION is not compulsory for selling from online platforms, whereas we suggest that you should get your trade name registered through trademark registry. As the brand will be the first and last thing that will be visible on the seller's platform and the most usable thing on the internet sale. If you do not want to get a claim notice from other brand owners whose brand you used! maybe wrongly! you should use a registered tradename.

If you wish to start with a registered trademark you need to do the following:

  • choose a trading name

  • choose a logo

  • register with trademark registry

  • above stated documents in point no. may be used for the same also
